By Patty Goff

In law, a lawyer or attorney whose traditional function is to advise and defend clients, individuals or legal entities, in court, pleading to assert their interests and, more generally, to represent them. The family court lawyer Bartlett TN performs an advisory role. In ancient Greece and Rome the accused had to defend themselves. Under the code of Solon, the accused must plead his case before the court, using the services of logographer if he was unable to produce a decent speech.

In Rome, the intervention of lawyers became common during the last centuries but legally cannot give rise to compensation. Any competent legal representative and brilliant orator is allowed to appear in courts. It requires a law degree to become an attorney and at least three years of work with practical legal training (usually as a paralegal) before appearing before the courts. Eligibility for becoming an attorney is provided for in Civil Code.

Professional training as a condition of access has been generally abandoned in late 1960s in favor of immediate exercise in workplaces (in practice) as an employed solicitor (associate). Lawyers can partner firms for which all structures are allowed: one-man company, professional firm or professional partnership.

However, it is forbidden for counsel to waive any fees if his client would succumb to justice. In Switzerland, the lawyer must hold a certificate issued by relevant authorities. Conditions vary from one canton to another, but the federal law on the free movement of lawyers (LLCA) defines the minimum requirements to be met lawyers to argue a case in the whole confederation. To be included in a list of trainee lawyers, the candidate must hold a Bachelor's degree (Bachelor) in law. Obtaining the certification, which allows registration as an attorney requires a masters in law.

Each state has its own legal system inherited from the common law, except Louisiana, which has kept the private law according to Civil Code, but has received the public right of common law. The federal law takes precedence over that of states. However, mobility between states is favored or between state and federal governments. The number of lawyers has more than quadrupled in the United States since 1967, especially during the early 1980s.

There are three types: the first is based on the number of hours devoted to dealing with the case. The second is calculated at a flat rate regardless of time spent on processing the case. The third is based on the result (for example, a certain percentage awarded by a court). However, in some jurisdictions it is not possible to agree on an outcome or fee, so the success fee shall be supplemental to the flat rate.

In case of dispute with your attorney, it is necessary to assert your grievance to President of Bar. It is possible to submit the grievance via e-mail or in writing based on documented complaints or disputed fees. In Canada, two legal traditions coexist in civil private law. Quebec private law and other matters of provincial jurisdiction, the Roman-civil law prevails.

However, in public law and other matters within federal jurisdiction, the common law applies. As for the other provinces, the common law is applied as private and public law. To hold the attorney status you must hold a bachelor's degree from a law school and a bar membership.
