The Benefits Of Getting An Uncontested Divorce Chicago

By Maryanne Goff

People that choose to get married, do so, because they believe they have found someone that they can see themselves with for an elongated frame of time. No one thinks on their wedding day, that their marriage is not going to last. However, the truth is that there are a lot of marriages that end in divorce. If the divorce can turn out to be an uncontested divorce Chicago affair, the situation will be better for both parties.

When divorces are considered to be uncontested, this simply means that both parties are able to agree upon the terms of separation. There are two different types of divorces. There are those, where both parties are able to settle their differences outside of a courtroom, and then there are the cases, where both parties disagree on the arrangements.

When divorces are contested, both parties will need to physically stand in front of a judge, and plead their cases. Individuals contesting the terms of the separation, will need to try to reach an agreement. If no agreement can be reached, then the judge in charge of the civil case, will reach an agreement for the parties.

Obviously, these types of divorces can be extremely stressful. Divorces that are not contested are the complete opposite of contested divorces. With uncontested divorces, both parties have sat down, and mutually addressed their concerns about the separation. They have set some ground rules, regarding which party gets what.

One advantage of settling on this type of arrangement, is the monetary savings that both parties will have. Since neither party will need to go to court, this saves a great deal of money on court fees. When parties are divorcing one another, any bit of money that they can save during this process, is a big help. By agreeing to work together, the entire escapade can be stress free and quick.

Uncontested divorces on the other hand, have a lot of benefits. First of all, if both parties are able to reach a mutual agreement, there is no need to get the courts involved. The only thing that one party will need to do is employ a lawyer to mediate the entire ordeal. The lawyer will draw up the paperwork that both parties will need to sign.

These types of divorces are also private affairs. It is important to remember that anytime that a case is seen in front of a judge, this case is automatically documented. This means that if the separation is contested, everyone will know about it, because it will become a public record. If you are a quiet person that wants to keep your private life private, contested divorces will not allow you to do so.

In order for an uncontested divorce Chicago, to work in your favor, both parties will need to agree on all terms of the proceeding. If the parties getting the divorce, are unable to tolerate one another, than this type of proceeding will not work. It is important that both parties treat each other with respect, and are able to sympathize with each other. Remember, that at one point and time, both of you, did care for one another. Just because the marriage has ended, this is no excuse to stop respecting each other.
