Requirements For K1 Fiance Visa

A k1 fiance visa is a document that makes it possible for the future husband of a United States citizen to enter the country as long as the marriage takes place within 3 months of entry. It is designed for foreign men that wish to have American spouses. Once the marriage has been formalised, the immigrant can apply for permanent citizenship. In the event that the marriage does not take place then the applicant is deported after 90 days.

The process of petitioning for the visa begins with filing a special form with the US Immigration Department. Hiring the services of an attorney in this case is optional. Once the petition has been filed, the US Immigration Services forwards it to the embassy closest to the foreigner. The foreigner is then asked to prepare for a medical examination and an interview at the embassy. The interview is meant to ascertain pre-existence of a genuine relationship between the two engaged to be married.

The embassy will approve the application only after being convinced that the relationship exists and conforms to the laid down legal requirements. Petitioners may wait up to 8 months before their application is approved. This may even be much longer if there are many inconsistencies in the information provided. The name of petitioner is printed on special adhesive label that is in turn affixed to the passport.

There are several requirements that must be fulfilled before this document is issued to any individual. One of the most significant is the fact that the spouses must have attained the legal age for getting into a marital relationship as spelt out in the United States legislation. Although, same sex relationships had been prohibited in the past, this has changed. Persons that are not eligible include those with a criminal record, former deportees and drug addicts.

The couple must have met physically at least once in two years prior to petitioning. An allowance is however given in cases where tradition or religion forbids such meetings. The applicant must be able to prove financial stability to ensure that he will not be a public liability while living in the US. The two must provide their identity with ID cards and birth certificates, together with divorce decrees (if any) to prove their eligibility of marrying.

The visas have been related to numerous frauds in the recent past with many illegal immigrants using this option to enter the United States. This has resulted into tighter rules as regards permanent citizenship. This citizenship is only given after at least two years of staying in the marriage. Even after the issuance of this citizenship, dissolution of the marriage can lead to nullification of citizenship.

Close monitoring of spouses is done within the first two years of marriage. This is meant to help uncover any evidence of fraud. Having common interests in the form of religion, properties, joint vacations and so on may be indicators of a genuine relationship. Dishonesty within the relationship may lead to suspicions of fraud.

Most of the applicants of the k1 fiance visa get their document. Accurately filled forms have a probability of close to 100% of being approved. Revocation will occur if one does not meet all the requirements or when evidence of fraud is identified.
